3. Liability - If someone is hurt in the building, whose liability <br />coverage will apply? <br />4. Workers' compensation - Whose employees are maintaining or <br />working in the building? If they are hurt, their employer's <br />workers' compensation coverage will apply. <br />5. Certificates of Insurance - The city should obtain certificates of <br />insurance from other parties involved in the building to make sure <br />that they have the insurance required. <br />6. Additional Insured - The best protection for the city if it is <br />transferring the risks to another party is to have the city named as <br />an additional insured under the other party's insurance policy. If <br />this is part of the agreement, make sure that the certificate of <br />insurance shows that the city was actually named. <br />F. Current <br />Make sure that the lease is current. There have been many claims where <br />the city has failed to update a building lease. <br />V. ALCOHOL USE <br />Alcohol use in a building presents additional risks. People using alcohol may be <br />more at risk for accidents. If there is a "sale of alcohol," then there is a possibility <br />of a dram shop claim if someone is injured by the person buying alcohol in the <br />building. The city should make sure that any organization which is selling alcohol <br />in the building has dram shop insurance. If alcohol is being used in a party or <br />social guest manner, it is important that there are no facts that would support an <br />argument that there was an alcohol sale. <br />VI. PRIVATE PARTIES <br />Be careful when contracting with private parties. If you agree to indemnify them, <br />the city will not be able to assert public immunities and liability limits. <br />Page 9 <br />
