MINUTES <br />PLANNING COMMISSION <br />MAY 8, 1997 <br />Keis recommended approval of the Comprehensive Plan Amendment <br />changing land use from industrial to mid - density residential, and <br />recommended approval of the rezoning of the property from Industrial - <br />Park to Planned Unit Development with R -2 underlying for the Petrina <br />Park Terrace proposal. <br />Motion seconded by Knudsen. <br />Motion carried 4 - 0. Mr. Montour abstained given that he is an adjoining <br />property owner. <br />Keis recommended approval of the Preliminary Plat for Petrina Park <br />Terrace as well as development stage approval of the Planned Unit <br />Development subject to compliance with the recommendations of the City <br />Planner as contained in his report dated May 5, 1997 and subject to there <br />being no side yard setback variance for the plat, directing the developer to <br />make adjustments in cul -de -sac locations to eliminate the need for a <br />setback. <br />Motion seconded by Knudsen. <br />Motion carried 4 — 0. Mr. Montour abstained given that he is an adjoining <br />property owner. <br />VARIANCE & Bernadette Belland, Belland Auto Repair, appeared before the <br />PROPERTY Commission requesting approval of a rear yard setback variance and <br />DIVISION/ a property division/combination. Belland Auto is purchasing a piece <br />COMINATION of property from the railroad which will be combined with the Belland <br />BELLAND property. Belland's would then like to add onto their existing building. <br />AUTO REPAIR Belland also indicated that they have obtained an easement from NSP for <br />construction of an addition onto their building. <br />The City Planner indicated that a rear yard setback variance is still <br />required even though a piece of railroad property is being acquired. The <br />problem with the first application was the proximity and angle of the <br />building to the property line. <br />Roger Stanke, adjacent property owner, reported that he, too, may want to <br />purchase property from the railroad in order that he might add onto his <br />building. Stanke asked if granting the Belland's variance would set a <br />precedent so that a similar variance would be approved for his property. <br />Schletty indicated that variances are considered on an individual basis and <br />there must be a unique situation to justify granting a variance. <br />Page 21 <br />
