Background and Analysis The applicants are seeking a Conditional Use Permit and Variance to permit the construction of an oversized residential garage at 790 Labore Road. The property is occupied by a single family home. On the property is an existing detached garage of 590 square feet. The applicants are proposing to add an attached garage to the house that would be approximately 918 square feet, according to the general dimension plans submitted with the application. The second garage, as well as the total garage space of more than 1,000 square feet, results in a requirement for Conditional Use Permit approval. Because the total garage floor area exceeds 1,500 square feet, the request also requires consideration of a variance, since the total garage space allowed by code is capped at the 1,500 square foot level for single family homes. Conditional Use Permit For the Conditional Use Permit, the zoning ordinance lays out the following standards: • No more than 10% of the rear yard can be covered by accessory building space. • No more than 1,500 square feet of total garage space can be constructed. • No other detached accessory sheds may be located on the property. In addition to these specific standards, Conditional Use Permits for such buildings are reviewed for their consistency with the general purposes of the zoning ordinance, such as compatibility with the property and area in which they are located, construction of a style and design similar to that of the principal building, and to ensure that the additional space is being use for residential purposes only.
