The retocation of the dwelling is subject to the setback requirements below. <br />The site plan submitted by the applicant is not to scale. However, there is sufficient lot <br />width and depth to comply with the District setback requirements <br />• Front: 30 Feet <br />• Side: 10 Feet <br />• Rear: 30 Feet <br />CONCLUSION <br />In review of the submitted materials, the applicant has demonstrated compliance with the <br />minimum zoning requirements. The applicant's failure to date to provide market evidence <br />related to property values for the dwelling, subject site and surrounding properties is an <br />omission that causes this application to be technically incomplete. Without the required <br />market value information, it is impossible to make a finding regarding the possible impact <br />of the proposed house relocation to the subject area. <br />Should the applicant provide clear and convincing evidence that the proposed conditional <br />use will not tend to or actually depreciate the aggregate property values in the area in <br />which the conditional use is proposed to the satisfaction of the Planning Commission and <br />City Council, our office would recommend approval of a CUP to allow for an existing single <br />family dwelling to be relocated to the lot located at 2591 Ruth Street, subject to the <br />following conditions: <br />1. The City Building Official inspect the dwelling at its present location. The applicant <br />shall comply with all requirements of the City Building Official regarding the <br />improvement, upgrade and move of the dwelling. <br />2. The dwelling shall comply with all applicable R -1 District setback standards. <br />3. The applicant provide evidence to the City that the dwelling is being moved by a <br />licenced contractor or company in accordance with applicable State regulations. <br />4. The applicant shall notify the City at least two weeks in advance of the timing and <br />route of the dwelling move. <br />Page 20 <br />
