Conditional Use Permit. The Planning Commission and City Council shall consider <br />possible adverse affects of the proposed conditional uses. The judgement of the Planning <br />Commission and City Council shall be based upon (but not limited to) the following factors: <br />1. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed conditional use has been considered in relation to the specific policies <br />and provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br />2. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of the area. <br />3. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained in the Zoning <br />Ordinance. <br />4. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed conditional use will not tend to or actually depreciate the aggregate <br />property values in the area in which the conditional use is proposed. <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />6. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of the <br />buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roofline; <br />b. Architectural style; and <br />c. Exterior finish materials. <br />Property Value. To date, the applicant has not provided any evidence as to the value of <br />the dwelling or the subject site and their relation to existing properties surrounding the <br />subject site. Without this information being provided, it is impossible to evaluate the <br />impact the proposed house move would have on existing property values in the subject <br />area. <br />Subdivision. The three parcels upon which the dwelling is to be located do not appear <br />to be combined. The three parcels, if combined into one lot, satisfy the minimum lot size <br />and width standards of the R -1 District of 10,000 sq. ft. and 75 ft. respectively. If the City <br />elects to grant a CUP to allow the dwelling to be relocated to the subject site, approval <br />Page 19 <br />
