Hanson <br />Attached is correspondence I have had with Mr. Mark Jaszewski of 2410 Dianna Lane. After recent wind <br />and rain storms, the retaining wall on his property is collapsing. Mr. Jaszewski feels the City has some <br />responsibility in that a portion of the wall may be located on the road right -of -way, the wall has been <br />placed to protect the street from the adjacent grade differential, and that the City alledgedly approved its <br />placement through the supervision of the City Engineer during the fall of 1977. He also points out the <br />City's involvement in the replacement of the Dianna Lane retaining wall located just off County Road B2 <br />at the entrance to this development. <br />I have explained to Mr. Jaszewski that the Dianna Lane retaining wall off County Road B2 was located <br />within our road right -of -way and therefore the City participated in this project. I also pointed out to him <br />that one of the property owners who brought this matter to our attention indicated that other walls were <br />largely the responsibility of private property owners. I explained to him that in order for the City to <br />participate, we need to show some public purpose to expend funds. <br />Mr. Jaszewski is also pursuing reconstruction of the wall through his insurance company due to the fact <br />that some trees blew over which he feels contributed to the damage of the wall. He is still awaiting word <br />from his insurance company on this possibility. I suggested to him that he needed to obtain some cost <br />estimates in order that we had an idea of what figures he was talking about if the City was even to <br />consider this matter. Attached is a quote he provided me with to address that issue. <br />At this time, I cannot recommend that the City participate in the wall construction without further <br />information andjustification. However, it is obvious that the wall needs attention. Therefore, I felt it was <br />appropriate to get any direction you may have in attempting to resolve this matter. <br />Mr. Jaszewski will likely be at Wednesday's meeting to pursue this matter with you further.
