Hanson <br />Tobacco Ordinance Revisions: <br />The State's new tobacco law became effective August 1, 1997. This law requires that <br />City ordinances contain at a minimum the State provisions relating to the following (see <br />July 2nd League article for specifics of each provision): <br />- Administrative penalty; <br />- Penalty for minors; <br />- Mandatory compliance checks; <br />- Prohibition on vending machine sales unless minors are at all times prohibited <br />from entering the licensed establishment; <br />- Prohibition on self - service sales of individual cigarette packages. <br />Cities have the option of being more restrictive than the new State Statute, but not less <br />restrictive. You will recall that earlier this year the City applied for an exemption from <br />Federal Law requirements. It is my understanding this is not an option with the State <br />Statutes. <br />In reviewing the City's Tobacco Ordinance as it relates to each of the State provisions <br />listed above, I have noted the following: <br />Administrative penalty — the City's ordinance appears to be more restrictive in <br />that fines are higher than the State's. <br />Penalty for minors — the City's ordinance does not contain a provision <br />establishing a penalty for minors. <br />Mandatory compliance checks — the City's ordinance states that any applicant or <br />Page 47 <br />
