licensee shall permit the City or its representatives to conduct <br />inspections /compliance checks. The ordinance does not establish a minimum <br />number of compliance checks per year. <br />Prohibition on vending machine sales, unless minors are at all times prohibited <br />from entering the licensed establishment - the City's ordinances places <br />restrictions on vending machines, but does not prohibit them at establishments <br />where minors are allowed. <br />Prohibit self - service sales of individual cigarette packages — the City's <br />ordinance does not allow the sale or dispensing by self - service of tobacco <br />products packaged in cartons containing less than ten individually <br />packaged tobacco products. <br />Please also note that Section 802.070.(c) requires compliance with all applicable <br />regulations of the State, and indicates that in any conflicts between State Statute and City <br />Ordinance the more restrictive regulations shall control. <br />It is staff's recommendation that the City Attorney be directed to amend the City's <br />Tobacco Ordinance to include the Statute provisions which have not been addressed in <br />the ordinance. This consistency will help us provide more accurate information to <br />licensees and the general public. <br />Compliance Checks: <br />State law now requires mandatory compliance checks of cigarette licensees. Attached is <br />a proposal from the North Suburban Tobacco Compliance Project to address this need. <br />Based on their rates and our number of licensees, the cost to use in 1997 would equal <br />$559. <br />Page 48 <br />
