MINUTES <br />PLANNING COMMISSION <br />AUGUST 14, 1997 <br />SPECIAL <br />USE PERMIT- <br />2570 JACKSON - <br />WAHLBERG <br />Mr. Montour recommended approval of the property combination for 38 <br />W. Woodlynn Avenue as requested by R & S Automotive subject to <br />compliance with the recommendations of the City Planner as contained in <br />his report dated August 11, 1997. <br />Motion seconded by Knudsen. <br />Motion carried 5 — 0. <br />William and Sandra Wahlberg, 2570 Jackson Street, appeared before the <br />Commission requesting approval of a Special Use Permit for a home <br />occupation to operate a mobile tool franchise from their property. Mr. <br />Wahlberg reported that they have two employees. These employees do <br />not operate from 2570 Jackson, but do visit the site to exchange inventory <br />and for employee meetings. Mr. Wahlberg estimated those visits at three <br />to four times per month. <br />Wahlberg reported that the business inventory is stored in their truck, and <br />the truck is stored in the garage on the property. <br />Knudsen asked about deliveries to the property. <br />Wahlberg estimated the number of deliveries at three to four per week, <br />with delivery trucks stopping for five minutes per delivery. <br />The City Planner reported that the home occupation issue came up <br />because concern was raised to the City about the number of employee <br />visits to the site as well as the number of deliveries. The Planner reported <br />that a special use permit for a home occupation is not required if there is <br />no acknowledgement of a business operating from a residential property. <br />However, once concern is raised, then a special use permit is required. <br />The goal is to preserve the residential character of the neighborhood. <br />Schletty asked the type of vehicles involved. <br />Wahlberg replied that the vehicles are 14,500 gross vehicle weight similar <br />to the UPS trucks which make the deliveries. <br />Ray Buchholz, 120 E. Lake Street and neighbor to the east, reported that <br />there are daily deliveries from UPS. Saturday deliveries are made by a <br />trucking firm from St. Joseph, Minnesota. Buchholz commented that a <br />semi has delivered to the site. Buchholz stated that when the Wahlberg's <br />asked to raise their garage there was never any mention that they would be <br />operating a business from their home, and the indication was that the <br />Page 10 <br />
