Special Home Occupation Criteria. Due to the need to have employees visit and UPS <br />deliveries to the residentially zoned site, the applicants are required to receive approval <br />of a special home occupation permit. Approval of a special home occupation permit is <br />subject to the criteria outlined in Section 903.120.E of the Zoning Ordinance. <br />Approval of a special home occupation permit requires that the Planning Commission and <br />City Council make a finding that the special home occupation will be clearly incidental and <br />secondary to the residential use of the property, will not change the residential character <br />of the property and will not result in incompatibility or disturbance to adjacent residential <br />uses. <br />CONCLUSION <br />The applicant's request for a special home occupation permit is generally consistent with <br />the provisions of the Zoning Ordinance. In consideration of the applicant's request for a <br />special home occupation permit, the Planning Commission and City Council must make <br />a finding as to whether the applicant's business, including employee visits and UPS <br />deliveries, is in keeping with the principal residential use of the property and residential <br />character of the area. Should the Planning Commission and City Council make such <br />a finding, our office would recommend that approval of a special home occupation permit <br />be subject to the conditions outlined below. However, should the Planning Commission <br />and City Council determine that the applicant's business operation is detrimental to the <br />residential character of the area, the request for a special home occupation permit must <br />be denied. <br />Employee visits that involve the parking of additional commercial vehicles in excess <br />of 10,000 lbs. GVW at the subject site shall not occur more than five (5) times per <br />calender month. <br />2. Comments of other City Staff. <br />pc.
