MINUTES <br />CITY COUNCIL <br />JULY 26, 1995 <br />/RESOLUTION NO. 45 -7 -179 - APPROVING 'ZUt: CANADA WOODS <br />f/ // DEvLLOPMENT AGREEMENT, AND AUTHORIZING THE MAYOR AND <br />CITY ADMINISTRATOR TO EXEeuuE THE AGREEMENT ON BEHALF <br />OF TILE CITY <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) LaValle, Pedersen, Scalze, Morelan. <br />Nays (0). Resolution declared adopted_ <br />ST. PAUL The City Administrator reported that the St. Paul Water <br />WATER Department is considering turning aver_the wetland <br />DEPARTMENT area in the Rice Street /Spruce Street area to either <br />PROPERTY the County or the City. The Water Department has asked <br />if the City is interested in ownership of this <br />�. property. The Administrator reported that he contacted <br />the Watershed to determine if they had an interest. <br />The Watershed indicated that typically the County is in <br />ownership of wetlands of this type. The Watershed does <br />have regulatory authority over the wetland, therefore, <br />feel they have adequate controls regardless of who owns <br />it. The Administrator stated that City staff would <br />favor County ownership of the wetland, pointing out <br />that the City can request any easements it wants at the <br />time a transfer occurs. <br />Morelan asked why this property would be publicly held. <br />The Administrator replied that the property should <br />remain publicly held because of its wetland status. <br />The Administrator reported that he felt the County <br />should take ownership of the. wetland since they had the <br />expertise to do so. <br />Morelan stated that he could not see why the City would <br />want to pursue ownership of the wetland. <br />Scalze suggested that the Park and Recreation <br />Commission comment on this issue. It was noted that <br />the Commission has expressed an interest in obtaining <br />an easement area around the wetland. <br />Morelan suggested that there may be some dry land the <br />Commission would have an interest in developing. <br />It was the consensus of the Council to place this <br />matter on the next agenda of the Park and Recreation <br />Commission meeting. <br />NO WAKE ZONE - The City Administrator reviewed correspondence from <br />GERVAIS LAKE the Sheriff's Department as well as Gordon Forbes, a <br />Page 15 <br />
