ANIMAL CONTROL CONTRACT <br />This agreement made this day of , 1997 , by and between Animal Control Services, Inc., <br />a Minnesota Corporation, hereinafter, referred to as "ASCI ", and the City of Little Canada , a <br />Municipal Corporation located in the County of Ramsey , and the State of Minnesota, hereinafter <br />referred to as "City", witness to: <br />In consideration of the covenants and agreements hereinafter set forth, it is mutually agreed by and <br />between the parties hereto as follows: <br />1. This agreement will be effective as of January 1, 1998 and will continue in effect until, <br />December 3,1998 , unless canceled, pursuant to Paragraph 15. <br />"ASCI" agrees to patrol the public streets of the "City" in a vehicle especially designed for <br />the transportation of small animals, in accordance with "City" Ordinances and a schedule <br />agreed upon by both parties. If such schedule is not agreed upon, the agreement shall be null <br />or void. The vehicle shall have proper identification displayed on two sides. "ASCI" <br />further agrees to insure, service, and maintain said equipment. <br />"ACSI" agrees that patrolling shall be done by competent personnel trained in the handling <br />of animals. Said employees shall perform their duties only while in proper uniform and <br />shall wear identification as to indicate employee's name, title, and place of employment. <br />The "City" shall authorize "ACSI" to apprehend and retain dogs, cats and/or issue citation <br />tags for violations of the "City" Ordinances. However, "ACSI" will not invade the private <br />property contrary to the wishes of the owner of said property nor forcibly take an animal <br />from any person without the approval and assistance of a Sheriff Deputy of the "City". <br />In addition to the regular hours of patrolling referred to, "ACSI" agrees to maintain one (I) <br />vehicle for standby service to attend to cases outside regular patrol hours at the specific <br />request of the Ramsey County Sheriffs Department. "ACSI" shall respond immediately to <br />any after hours emergency call, agreed upon by the City of Little Canada and confirmed <br />to be an emergency. <br />"ACSI" represents and agrees that all animals impounded shall be kept at WHITE BEAR <br />KENNEL, 1283 HAMMOND ROAD, WHITE BEAR TOWNSHIP, MN. "ACSI" agrees <br />and warrants that all animals impounded shall be kept in a comfortable and humane manner <br />for a period required by the "City" Ordinance. It is mutually agreed that "ACSI" <br />immediately available at the contract facility. <br />7. At the time that an animal impounded under this contract is reclaimed, "ACSI" or its agent <br />shall collect the impounding fee and boarding charges as provided by "City" Ordinance. <br />All impounding fees and/or any other penalty fees collected by "ACSI" or its agent shall be <br />remitted to the "City ". <br />Page 18 <br />
