612 - 321 -4833 MINNEGRSCO HR <br />957 P06 SEP 22 '97 11:38 <br />presence of the antennas, towers, or poles. when able, <br />the County agrees to notify the provider before the costs <br />are incurred or request that the provider directly remedy <br />the situation. <br />1. Towers and poles will be set back one times the height of <br />antenna plus 10 feet from any County or neighboring <br />structure or from areas frequented by the public, like <br />beaches or compost sites, unless the city zoning ordinance <br />in which the land is located requires a bigger setback. <br />m. All towers and poles shall be reasonably protected against <br />unauthorized climbing. <br />n. No advertising or identification of any kind is permitted <br />except applicable warning and equipment information <br />signage required by the manufacturer or by Federal, State <br />or local authorities. <br />o. Antennas, towers or poles are prohibited from designated <br />conservation areas /open space, regional and county parks, <br />and golf courses unless necessary for functioning of the <br />entire communication system and no other alternative is <br />available. (The Metropolitan Parks and Open Space <br />Commission has amended. it's Development Guide to include <br />such a prohibition.) Any lease of park property for use <br />inconsistent with park purposes must meet special <br />provisions outlined in the Ramsey County Home Rule <br />Charter, Section 2.02 (K). <br />p. The provider must obtain all necessary land use approvals <br />and submit evidence of such approval at the time of final <br />approval of a lease agreement with the County. <br />q. The County may terminate any lease with 60 days notice if <br />it determines that a potential user with a higher priority <br />cannot find another adequate location and the potential <br />use would be incompatible with the existing use or a <br />user's frequency broadcast unreasonably interferes with <br />other users of a higher priority, regardless of whether <br />this interference was adequately predicted in the <br />technical analysis. This provision does not preclude the <br />County from exercising termination rights for any other <br />reason consistent with a lease agreement. <br />r. All structures erected by the telecommunications provider <br />must be properly maintained throughout the term of the <br />lease by the provider. The provider shall provide advance <br />notice of entry on to property for servicing the antenna, <br />tower or pole to a contact person identified by the <br />department responsible for the property. <br />s. The county will give preference the siting of antennas on <br />existing buildings, towers, or poles when possible. <br />Page 38 <br />
