MINUTES PLANNING COMMISSION OCTOBER 9, 1997 PROPERTY DIVISION — 353 ROSE LANE reported that he is recommending that the property be platted in order to eliminate the complex metes and bounds descriptions that would otherwise exist. The Planner noted that the streets and alleyways through the site have already been vacated. Keis asked why a portion of the site is being donated to the County rather than to the City. The Planner was not sure, but pointed out that the site is the Water Department's to do with as they wish. Again, it was noted that the property to the north is already owned by the County. Mr. Schletty recommended approval of the Preliminary and Final plat of the St. Paul Water Department property was submitted subject to compliance with the recommendations of the City Planner as outlined in his report dated October 6, 1997. Motion seconded by Barraclough. Motion carried 6 — 0. The City Planner explained that a property division has previously been approved for 353 Rose Lane. However, the division was not recorded, and the approval lapsed. Mr. David Whitman has now applied for reapproval of that property division. The division takes an "L- shaped lot" and divides off a portion so that the result is two rectangular- shaped lots abutting Rose Lane. Mr. Richard Moy, property owner in the area, asked if the property division is being sought in order to construct another home in the area. The Planner replied that this would not be the case. The result of the property division will be two rectangular- shaped lots abutting Rose Lane. An additional buildable lot is not being created as a result of this property division. Moy asked if the property owner would be required to clean up the property. Keis pointed out that this is a code enforcement issue that Mr. Moy should report to the City. Mr. Montour recommended approval of the property division for 353 Rose Lane as requested by Mr. David Whitman. Motion seconded by Schletty. Page 9
