MIND 1ES <br />PLANNING COMMISSION <br />OCTOBER 9, 1997 <br />and one tower on the Donovan property along South Owasso Blvd. as well <br />as antennae on the City's water tower. <br />Keis asked if another antenna were placed on the City's water tower if <br />another utility building would be required. The Planner replied that that is <br />correct. <br />ARCHITECTURAL Mr. Mike Lawrence, Sign Crafters, appeared before the Commission <br />REVIEW requesting architectural review in order that Arby's may use backlit <br />canopies on its building. It was noted that the Commission did an <br />architectural review for Arby's at its last meeting. At that meeting metal <br />awnings were approved by the Commission. Lawrence reported that <br />Arby's national headquarters in Miami has the position that they do not <br />accept anything but backlit canopies on their buildings, unless the Arby's <br />is a part of a shopping center and must fit a design standard for that <br />shopping center. Therefore, Arby's corporate office is asking for backlit <br />vinyl covered awnings with internal illumination. <br />Lawrence reported that the City Planner has taken the position that these <br />awnings are similar to plastic panel signs and that vinyl materials are not <br />natural. Lawrence reported that the City's architectural guidelines contain <br />no regulations prohibiting backlit canopies. There are policies and <br />recommendations against the canopies, but nothing prohibiting them. <br />Lawrence also pointed out that the guidelines say that the regulations have <br />been adopted as part of the Code, but the policies and recommendations <br />have not. Therefore there are no regulations or ordinances in the Sign <br />Code that prohibit backlit canopies. <br />Carson pointed out that at the September meeting, Arby's presented the <br />awnings as metal, and the Commission approved the building based on <br />that presentation. <br />Keis pointed out that buildings in the B -3 zoning district require <br />architectural approval. Although backlit canopies may not be specifically <br />prohibited by regulation, a building still requires architectural approval. <br />The City Planner pointed out that the Planning Commission raised the <br />issue of the awnings as part of the architectural review commenting that <br />they hoped the awnings were not backlit canopies. The Arby's <br />representatives present at that meeting stated that the awnings would be <br />either metal or canvass. The Planner agreed that the regulations in the <br />architectural guidelines do not prohibit backlit canopies. However, the <br />architectural guidelines also contain policies, and the policies recommend <br />against the backlit canopies. The policies stated that if a feature proposed <br />Page 43 <br />
