MINUTES <br />CITY COUNCIL <br />FEBRUARY 28, 2013 <br />Montour asked for a synopsis of the issues. The City Administrator stated <br />that it was his interpretation that the Brausen Family would like to recover <br />some value from their land sooner rather than later. Boog and Acosta <br />would like to maintain things as they are right now, but not preclude future <br />development of their properties. "fhe ghost plat provides a development <br />option for these properties. He noted that the Brausen Family has <br />submitted their preferred option as well as an option which utilizes the <br />existing 33 -foot road easement. The Administrator noted that utilizing the <br />existing road easement appears to be the least desirable in that it results in <br />double and triple frontage lots. The ghost plat angles a cul -de -sac street <br />through the Boog and Acosta properties and requires cooperation of all <br />three property owners in order to proceed with any development of the <br />northeast properties. The Brausen option would also require the <br />cooperation of Boog and Acosta as they would have to pay their share of <br />infrastructure costs. The Administrator suggested that the solution appears <br />to be proceeding with the ghost plat option with the City purchasing the <br />developable portion of the Brausen property and acquiring option <br />agreements on the Boog and Acosta properties. In that way, the Brausens <br />can realize a return on their property while Boog and Acosta could retain <br />their properties as is until they are ready to sell. The Administrator <br />indicated that the challenge will be in how to value the Brausen property. <br />McGraw asked if the Brausens were open to the potential sale of their <br />developable property to the City. Dave Brausen stated that they were <br />open to this discussion. <br />McGraw pointed out that it is the City's job to try to find a compromise to <br />the competing interests of the various property owners. He also stated that <br />he did not want to see property owners forced into anything. <br />The City Planner noted that the plat is depending on the vacation of the <br />road easement. He noted that Gordie Howe is trying to create a <br />neighborhood that he can market and sell, and this is why the ghost plat <br />works for him. The Planner recommended that if the Council moves <br />forward with Preliminary Plat approval that the approval be contingent <br />upon the vacation of the road easement. The City Administrator noted <br />that the Final Plat will come back to the City Council for approval. <br />Acosta pointed out that the Pinetree Ponds plat abuts 463 feet of her <br />property with four lots. She expressed concern that there has been no <br />conversation about privacy plantings for her property. She also expressed <br />concern about traffic safety issues on LaBore Road and the addition of <br />another street on the LaBore Road curve. The City Administrator <br />reminded Acosta of the discussion staff has had with her regarding <br />11 <br />
