MINUTES <br />CITY COUNCIL <br />FEBRUARY 28, 2013 <br />building pads and not house locations. Howe indicated that all setback <br />requirements would be met without need for a Variance. <br />Montour again noted for the record the letter received from Jan and Mike <br />13ilek. <br />Gordie Howe thanked the Council for their time this evening and <br />requested approval of the Pinetree Pond Preliminary Plat as presented. I -Ie <br />indicated that he would like to keep the process moving forward, and his <br />goal would be to have a house in the fall Parade of Homes. Howe stated <br />that if the Preliminary Plat is approved, he would like to request two <br />building permits from the City, one for a model and one for a spec home. <br />I -Iowe indicated that the homes he is planning for this development will <br />consist of both two -story and rambler designs ranging in value from <br />$450,000 to $575,000. <br />Keis asked what the impact would be if the road easement is vacated and <br />the County decides that the entire area does not accrue to 2966 Arcade <br />Street. Howe indicated that he would still proceed with the plat, but <br />would have to move the road slightly to accommodate for the loss of the <br />road easement land. Howe then reviewed the history of the road <br />easement, noting that it was dedicated in 1968 by Harriett Brown and was <br />part of the 2966 Arcade Street property. Howe stated that this 33 foot <br />easement is still a part of the legal description for 2966 Arcade Street. <br />Howe also pointed out that at the time the 33 feet was dedicated, the City <br />required 66 feet for a residential street. Therefore, Brown dedicated half <br />the required road easement with the expectation that the other 33 feet <br />would come from the adjoining property. <br />The City Administrator recommended that building permits not be issued <br />in the Preliminary Plat stage of the process, but rather in the Final Plat <br />stage and as part of a Development Agreement. <br />McGraw asked about the surveyor's letter relative to the road easement. <br />The City Attorney indicated that the letter states that the road easement <br />area came from 2966 Arcade Street. Based on that, if the easement is <br />vacated, it should revert back to the property owned by Gordie Howe free <br />and clear. The City Administrator noted that City Ordinance suggests <br />access to adjoining properties should be evaluated to attempt to avoid <br />landlocking adjacent properties. The ghost plat provides for development <br />access for the properties to the northeast in lieu of the 33 -foot road <br />easement. The Administrator stated that it would be staff's goal to try to <br />resolve the issue of development access to the northeast properties prior to <br />the vacation hearing. <br />10 <br />
