MINUTES CITY COUNCIL FEBRUARY 28, 2013 The Administrator reviewed three options for addressing this current contract violation, recommending a reduced penalty calculated based on a percentage of the $2,500 liquidated damages penalty outlined in the contract based on the respective service area of each hauler. This would result in apenalty of $25 to Gene's Disposal, $1,025 to Waste Management, and $0 to Allied Waste Services given that while they did not notify the City of the tipping fee reduction they did bill the City at the reduced rate. The Council discussed this issue at length expressing concern about the amount of time that City staff has to spend enforcing this contract with the haulers. The Council discussed such options as imposing the penalty recommended, requiring the haulers to attend a Council meeting to discuss their performance relative to the contract, etc. The City Administrator reported that City staff is holding a meeting with Waste Management next week, and suggested that he raise the issue of the contract breach and inform him of his intent to bring this matter to the Council for action. The Administrator suggested that he report to the Council on the outcome from that meeting. McGraw introduced the following resolution and moved its adoption: RESOLUTION NO. 2013 -2 -36 — TABLING ACTION ON THE ORGANIZED COLLECTION CONTRACT VIOLATION UNTIL THE MARCH 13, 2013 COUNCIL MEETING PENDING A REPORT FROM THE CITY ADMINISTRATOR The foregoing resolution was duly seconded by Boss.
