Mr. Hanson <br />March 22, 1996 <br />Page Two <br />In this situation, the violation was the sale of intoxicating <br />liquor on January 1, 1996, which is specifically prohibited by <br />Little Canada Code Section 703.140 (2). <br />As a result, the Little Canada Ordinance imposes a mandatory <br />procedure and provides for either a suspension of the license for <br />a period not to exceed sixty (60) days, revocation of the <br />license, or the imposition of a fine, which may not exceed <br />$2,000.00, for each violation. Please note that although state <br />law was amended in 1994 to make City Council action against a <br />licensee permissive rather than mandatory, the Little Canada <br />Ordinance is controlling and requires the Council to take some <br />action upon a showing of a violation. <br />Even though the Little Canada Ordinance provides for <br />mandatory action by the City Council, the severity of the <br />disciplinary action is entirely in the discretion of the City <br />Council.
