702.060. PERSONS INELIGIBLE FOR A LICENSE. No license shall <br />be granted to or held by any person who: <br />(1) Is under 21 years of age; <br />(2) Has, within five (5) years prior to the application for <br />such license, been convicted of violating any law of this State or <br />local ordinance relating to the manufacture, sale, distribution, or <br />possession for sale or distribution of intoxicating or <br />nonintoxioating 3.2 percent malt liquor, and cannot show competent <br />evidence under Minnesota Statutes Section 364.03 of sufficient <br />rehabilitation and present fitness to perform the duties of a <br />nonintoxioating 3.2 percent malt liquor licensee; <br />(3) Is a manufacturer of nonintoxicating 3.2 percent malt <br />liquor or is interested in the control of any place where <br />nonintoxicating 3.2 percent malt liquor is manufactured; <br />(4) Is not a citizen or resident alien; <br />(5) <br />Is not a good moral character; <br />(6) Is not the proprietor of the establishment for which the <br />license is to be issued; <br />702.070. CONDITIONS OF LICENSE AND GROUNDS FOR SUSPENSION OR <br />REVOCATION. <br />(1) Every license shall be granted subject to the conditions <br />in the following paragraphs and all other provisions of this <br />ordinance and of any other applicable ordinances of the City or <br />State law. <br />(2) Compliance with financial responsibility requirements of <br />State law and of this ordinance is a continuing condition of any <br />license grant pursuant to this chapter. <br />(3) No nonintoxicating 3.2 percent malt liquor shall be sold <br />or served to any obviously intoxicated person or to any person <br />under 21 years of age. <br />(4) No person under the age of 21 years shall be permitted to <br />consume nonintoxicating 3.2 percent malt liquor on a license <br />premises. <br />(5) No corporation to which a license has been granted shall <br />transfer any stock in such corporation without the consent of the <br />City Council. The officers of any corporation holding a license <br />shall notify the City Council of any proposed sale or transfer of <br />any stock in the corporation. The transfer of any stock without <br />the knowledge and consent of the City Council shall be deemed <br />sufficient cause for revocation of the license by the Council. <br />702 -4 <br />Page 60 <br />
