MINUTES <br />CITY COUNCIL <br />MARCH 27, 1996 <br />PUBLIC <br />HEARING - <br />REZONING OF <br />10 W. COUNTY <br />ROAD C <br />PUBLIC <br />HEARING - <br />REZONING OF <br />RICE STREET/ <br />LITTLE CANADA <br />ROAD AREA TO <br />PUD <br />utility easement over the water main which will be <br />installed on the property. <br />The City Administrator suggested that the easement for <br />the water main should be addressed with the final plat. <br />Scalze introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 96 -3 -69 - VACATING A 20 -FOOT DRAINAGE <br />AND UTILITY EASEMENT SHOWN LYING BETWEEN LOTS 1 AND 3, <br />BLOCK 1, HERITAGE OFFICE PARK AS REQUESTED BY REAL <br />ESTATE MASTERS SUBJECT TO A DEDICATION OF A 20 -FOOT <br />EASEMENT ON THE FINAL PLAT OF THE PROPERTY FOR WATER <br />MAIN AS RECOMMENDED BY THE CITY ENGINEER AND PUBLIC <br />WORKS DIRECTOR <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4) Scalze, Morelan, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Fahey opened the Public Hearing to consider the <br />application for rezoning of 10 West County Road C from <br />R -1 (Single - Family Residential) to R -2 (Medium - Family <br />Residential) submitted by Gene Fasciana. It was noted <br />that Mr. Fasciana has requested that this matter be <br />tabled for one month so he can meet with property <br />owners in the area and show them drawings of the <br />twinhome he is proposing for the site. <br />Morelan introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 96 -3 -70 - CONTINUING THE PUBLIC HEARING <br />ON THE PROPOSED REZONING OF 10 WEST COUNTY ROAD C UNTIL <br />THE APRIL 24, 1996 REGULAR COUNCIL MEETING <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) Morelan, Scalze, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />Fahey opened the public hearing to consider the <br />rezoning of certain properties within the Rice Street/ <br />Little Canada Road area from Residential (R -1), <br />General Business (B -3), Industrial Park (I -P), or <br />Residential Business (RB), to Planned Unit Development <br />(PUD). Fahey noted that the Council acted to approve <br />the rezonings in January, 1996. However, due to a <br />defect in the hearing notice, the Public Hearing is <br />2 <br />Page 18 <br />
