MINUTES <br />PLANNING COMMISSION <br />APRIL 11, 1996 <br />considered for a property on Jackson and Lake Streets, <br />and the City required the building size be decreased. <br />Knudsen asked where Beam Avenue would go if it were <br />extended to the west. Keis pointed out that a cul -de- <br />sac could be extended west. <br />Battista pointed out there is only 33 feet dedicated <br />for Beam Avenue along his south property line since <br />Maplewood never required a similar dedication. <br />The City Planner stated that it did not look possible <br />to extend Beam Avenue to the west. <br />Knudsen pointed out that the barn Mr. Battista is <br />proposing would not be visible, therefore, would not <br />disturb aesthetics. <br />Schletty agreed, but pointed out the area is zoned R -1. <br />Knudsen indicated that the Battista property was not a <br />typical piece of property. <br />Keis pointed out that approval of the CUP would be <br />setting a precedent. Keis felt the fact that the barn <br />would not be visible was irrelevant. <br />The City Planner stated that a Conditional Use Permit <br />is not the same as a Variance. Therefore, setting a <br />precedent is not such an issue. The Planner <br />recommended, however, that should the Planning <br />Commission recommend approval of the CUP, it should <br />make some determination as to why the building should <br />be over 1,500 square feet. Historically, the City has <br />granted CUPs in the 1,000 to 1,500 square foot range, <br />and in at least one request the City required the <br />building to be reduced in size. That particular <br />building was located on an over -sized lot as well. <br />The Planner pointed out that the structure proposed by <br />Mr. Battista is very large, and has an attic and <br />basement. The Planner suggested the barn may be larger <br />than the Battista house, which raises the issue of just <br />what is the actual principle building on the property, <br />the home or the garage. The Planner stated that in his <br />view at least the size of the building should be <br />reduced, and more information should be obtained on the <br />size of the house. <br />2 <br />Page 31 <br />
