MINUTES <br />PLANNING COMMISSION <br />APRIL 11, 1996 <br />It was suggested that the number of cars could be <br />limited. Schletty asked if the CUP would run with the <br />land or the operator. <br />The Planner replied that a CUP runs with the land, and <br />could be replaced by someone with a similar use within <br />a certain period of time. <br />Knudsen felt it unfair to a business currently <br />operating in the City to make them move. <br />Schletty pointed out that the car rental agency has <br />been operating illegally in a B -3 District. <br />DeLonais suggested that the City allow the agency to <br />phase out over a period of 2 to 3 years. <br />The Planner stated that there is no ordinance which <br />allows an illegal business to phase out. The business <br />either has to find another location, or the ordinance <br />must be amended to make the business fit. <br />Carson pointed out that the City has an agreement with <br />Frattalone Excavating allowing their recycling <br />operation over a certain period of time. <br />The Planner pointed out that that is a contractual <br />agreement the City entered into. The Planner suggested <br />that if the Commission wanted to allow the business to <br />remain with a limitation on the number of cars it can <br />have, that can be a part of the Conditional Use Permit. <br />The Planner noted that Alliance Car Rental indicated <br />that the most they ever have is 4 cars. <br />Knudsen recommended approval of the Text Amendment to <br />the General Business District (B -3) to allow by <br />Conditional Use Permit a small automobile rental <br />operation as requested by Alliance Car Rental for <br />location at 80 Minnesota Avenue with the condition that <br />no more than four (4) cars are allowed. <br />Motion seconded by Schletty. <br />Motion carried 7 - 0. <br />ARCHITECTURAL DeLonais summarized Council discussion regarding <br />STANDARDS application of architectural standards to pylon signs. <br />9 <br />Page 54 <br />
