MINUTES <br />CITY COUNCIL <br />MARCH 9, 1994 <br />CONCEPT <br />REVIEW - <br />R-2 <br />DEVELOPMENT <br />1HE MITrinTr.T, <br />PROPERTY <br />can be applied uniformly to all property owners in the <br />City. <br />Pedersen pointed out that the property is unique in <br />that the shopping center does not lie parallel to Rice <br />Street and the signs on the front of the shopping <br />center cannot be seen from the street. Pedersen was <br />concerned that the minutes would not reflect all the <br />previous discussion the Council had on this issue, <br />noting that the matter was first presented and <br />discussed by the Council at its January 26th regular <br />meeting. Pedersen pointed out that that discussion is <br />the basis for the action that the Council will take on <br />this variance request. <br />Morelan pointed out that item #2 of the January 10th <br />Planners report indicates that the hardship is the <br />layout of the building on the property. <br />Scalze did not believe the larger sign should be <br />approved in such a way so that no one else has a legal <br />right to such a sign. <br />Mr. LaVaile introduced the following resolution and <br />moved its adoption: <br />R SOLUTION NO. 94 -3 -56 - APPROVING THE VARIANCE TO THE <br />IGN PROVISIONS OF THE ZONING ORDINANCE ALLOWING A <br />vvvvvv FREE- STANDING SIGN WHICH EXCEEDS THE MAXIMUM SURFACE <br />AREA OF 200 SQUARE FEET AS REQUESTED BY TEAM <br />PROPERTIES, REPRESENTING THE MARKET PLACE SHOPPING <br />CENTER, DUE TO THE HARDSHIP WHICH EXISTS IN THE LAYOUT <br />OF THE BUILDING ON THE PROPERTY, SUBJECT TO COMPLIANCE <br />WITH OPTION #2 IN THE CITY PLANNER'S REPORT DATED <br />JANUARY 10, 1994, AND SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) LaVaile, Morelan, Hanson, Pedersen. <br />Nays (1) Scalze. Resolution declared adopted. <br />Mr. Jon Uban, Dahlgren, Shardlow and Uban, appeared <br />before the Council and presented a concept proposal <br />for the rezoning of the John Mitchell property in <br />Little Canada to R -2 and development of the site with <br />13 townhome structures totalling 26 units.
