AMENDMENT TO LITTLE CANADA REFUSE SERVICE CONTRACT This document dated 1996 shall serve as an amendment to the Little Canada Refuse Service Contract between the City of Little Canada, herein referred to as "City," and Woodlake Sanitary Service, Inc., Gene's Disposal, Inc., Bellaire Sanitation, Inc., and Joe Horrigan Hauling, herein referred to collectively as "Contractor," dated November 24, 1995. The pricing set forth herein shall take effect on January 1, 1997. Current pricing and all other provisions of the original contract shall remain in effect until that date. WITNESSETH: WHEREAS, the City has contracted with the Contractor for refuse service; and WHEREAS, all participants wish to make changes to the contract; NOW THEREFORE, it is mutually agreed to modify the Little Canada Refuse Service Contract between the City and Contractor as follows: I. Section 1.a. and b. on pages 1 and 2 shall be deleted. The following wording shall be substituted in its place: "1. Term. This Contract shall be in full force and effect for the period beginning January 1, 1997 and ending December 31, 2001." II. Section 9.a. on page 8 shall be amended to read: "Collection Service. The resident owner shall pay the Contractor one price for refuse collection service, and one price for recyclable collection service as outlined in Attachment "A ". The residential dwelling unit price is not subject to revision until January 1, 1999 and no modifications to pricing may be made until that time except in the event an increase in tipping fees of greater than 10% occurs. If such an event occurs, the Contractor and City shall review the circumstances and address the fees in a mutually agreeable manner. The following provisions of Section 9. are suspended until January 1, 1999: (1) The residential dwelling unit price may be subject to revision effective January 1 of each year upon request of the Contractor, with increases or -1- Page 121
