MINUTES <br />PLANNING COMMISSION <br />OCTOBER 10, 1996 <br />Motion carried 6 - 1. Carson voted against. <br />Keis recommended approval of a Conditional Use Permit <br />to allow Grand Slam to operate a commercial <br />recreational use in the Di -Med Corporation building <br />located at 2956 Yorkton Blvd. subject to compliance <br />with the recommendations of the City Planner as <br />contained in his report dated September 9, 1996. <br />Motion seconded by Carson. <br />Motion carried 7 - 0. <br />APPEAL OF Mr. Richard Thorp, 470 Costa Lane, appeared before <br />VARIANCE the Commission to appeal the Council's denial of <br />DENIAL - his application for a Variance in order that he could <br />THORP retain a shed which is encroaching into the required <br />side yard setback. Thorp reported that he applied for <br />a building permit, was granted the permit, poured a <br />slab and started construction of the shed. He was then <br />told to stop construction because the shed was within <br />the side yard setback for a corner lot. Thorp <br />submitted a petition signed by the majority of his <br />neighbors stating they had no opposition to the shed. <br />Thorp reported his neighbor across the street informed <br />him that he has complained about the shed since he <br />believes it to be an eyesore. Thorp reported the <br />neighbor only has one small window facing in that <br />direction. The neighbor also indicated he has concerns <br />about the lawn care business Thorp operates from his <br />home. <br />Mr. Thorp indicated he is aware of at least 40 sheds in <br />Little Canada which do not comply with setback <br />requirements. Thorp reported that his shed is sided <br />and roofed to match his house, and will be painted the <br />same color. Thorp indicated he needs the shed to store <br />his children's toys. <br />Keis pointed out that at the last Planning Commission <br />meeting, the Commission sympathized with Thorp's <br />situation and recommended approval of the variance. <br />However, the City Council denied the variance as there <br />was no hardship present. At the same time, however, <br />the Council indicated that the City would assist in <br />moving the shed, since the building permit was issued <br />in error. <br />5 <br />Page 21 <br />
