Hanson <br />The following information is a synopsis of the manufactured home <br />zoning issue we are dealing with: <br />* With the exception of a portion of Terrace Heights, the <br />mobile home parks within the City are not zoned properly. <br />Therefore, they are considered lawful non - conforming uses. <br />A strict reading of our ordinance would require that <br />individual units may not be replaced as they would be <br />extending the non - conformity. (See Attachments 1 and 2) <br />* Application of our R -4 regulations to the non - conforming <br />areas will not solve the problem. Application of the design <br />standards contained in this ordinance will also result in <br />non - conformities. (See Attachment 3) <br />* Double -wides have been moving into North Star Estates to <br />replace single -wide units. We have received calls on this <br />topic from neighbors who are concerned about the impact this <br />larger unit is having on their site. They have questioned <br />the appropriateness of this action which raises the <br />previously mentioned zoning issue. (I can not gauge the <br />magnitude of this concern as we have not been inundated <br />with this type of call.) <br />* A recent case involving the City of Apple Valley as well <br />as Minnesota Statutes Chapter 462.357 (See Attachment 4) <br />prohibit a municipality from enacting more restrictive <br />setback requirements for any park constructed before January <br />1, 1995. Given the fact we had no setback or density <br />requirements in place due to the non - conforming use issue, <br />the only standards we would be able to apply are those in <br />State Statutes and County Ordinances. <br />Page 37 <br />
