The property is a part of the project which <br />resulted in the construction of a cul -de -sac at the end of Australian. As a part of this <br />project, seven feet of Jackson Street right -of -way was vacated to the Morelan property on <br />the east side of Jackson. The City effectively declared that the Jackson Street right -of- <br />way would not qualify as a City street, and as such, only typical side yard setbacks to the <br />property line would be required. <br />Analysis <br />The applicant for a Conditional Use Permit must satisfy the requirements of the CUP <br />procedures, which include a review of the structure proposed for the site. The proposed <br />structure is a split entry home of just of 1,400 square feet on the two levels, including all <br />utility and unfinished living spaces. A double attached garage is shown on the site plan, <br />as is a possible addition.
