The Jackson Street side is to be treated as a side yard, as is the Railroad side. The south <br />boundary would constitute the rear lot line. Setbacks to these lot lines are acceptable <br />under the proposed plan. However, the front yard setback of 30 feet must be maintained <br />to the Australian Avenue cul -de -sac. This could be accomplished by shifting the structure <br />approximately 11 feet to the south and lengthening the driveway. Under this design, the <br />future addition could be accommodated without problem, and the project would meet all <br />setbacks without variance, a requirement of the Conditional Use Permit evaluation criteria. <br />In addition to those mentioned above, one new criterion must be met by the applicant, <br />added by an amendment to the Ordinance in 1995. For Conditional Use Permits, <br />particularly those dealing with house moving, the applicant must show that the proposal <br />will not result in a depreciation of property values in the area. This requirement relates to <br />the size, character, and architectural appearance of the proposed structure. The applicant <br />should be prepared to present this information at the upcoming Planning Commission <br />meeting as a condition of the application. The applicant should be aware that until this <br />information is submitted, the application must be considered incomplete. <br />Finally, the lot on which the proposed house is to be located has yet to be recorded <br />following the subdivision which was approved last year. No building permits may be <br />issued until the recording is completed with Ramsey County. <br />Summary and Recommendations <br />The proposed moving of a house onto a lot at the end of Australian Avenue appears to be <br />consistent with the requirements of the Conditional Use Permit process. We recommend <br />approval of the CUP subject to the following conditions: <br />1. The applicant provides evidence that the proposed CUP will not depreciate property <br />values in the neighborhood. <br />2.
