MINUTES <br />PLANNING COMMISSION <br />MARCH 14, 2013 <br />Barraclough felt that the Jaede proposal to combine the parcels was a good <br />one and preserves the history of the property. Barraclough indicated, <br />however, that he did not support the Variance request, and felt there was <br />no basis to justify the Variance. Barraclough noted that scaling the new <br />garage back by one foot on the depth would bring it under the 1,500 <br />square foot maximum. <br />Schwalbach noted the need to determine that without the Variance the <br />property owner would have "practical difficulties" in putting the property <br />to a reasonable use. Schwalbach agreed that the garage should be scaled <br />back by one foot. <br />Maleitzke asked if Jaede would tear down the old garage rather than scale <br />back the new one. Jaede indicated that he has decided that he wants to <br />retain the old garage. <br />Schwalbach asked if any other variances of this nature have been <br />approved. The City Planner stated that he cannot recall the Council <br />approving a Variance to allow garage space over 1,500 square feet. <br />Fischer stated that he appreciates what the Jaede's are doing with the <br />property, but indicated that he is struggling with the Variance request. <br />Fischer pointed out that decreasing the new garage size slightly would get <br />the total space under 1,500 square feet. <br />Murphy stated that she disagreed with the comments made relative to <br />Variance standards, and felt that the Commission only had to determine <br />whether or not the Variance request was reasonable. Murphy stated that <br />given the size of the property, she felt the request was reasonable. <br />Terry Kelsey, property owner in the area, felt the plan looked good and <br />asked for an explanation of the upstairs floor plan, which Jaede provided. <br />Kelsey stated that his main concern was that Jaede was asking for one <br />garage of 1,500 square feet, and he was pleased to learn that the square <br />footage is a combination of two garages. <br />Barraclough stated that while he supported the Conditional Use Permit, he <br />could not support the Variance. <br />Barraclough recommended approval of a Conditional Use Permit <br />allowing total garage space over 1,000 square feet for property located at <br />790 LaBore Road owned by Chris and Katya Jaede subject to the <br />recommendations of the City Planner as outlined in his March 8, 2013 <br />report. <br />-7- <br />
