JUN -18 -1996 14:42 <br />CITY OF SHOREVIEW P.03/04 <br />(D) Every licensee is responsible for the conduct of its employees <br />vhile on the licensed premises and any sale or other <br />disposition of Tobacco Products by an employee to a person <br />under eighteen (18) years of age shall be considered an act of <br />the licensee. <br />(E) The issuance or renewal of a tobacco products license shall <br />require attendance by licensee and or licensee's representative <br />at a training workshop approved or sponsored by the City. <br />Signed Affidavits of Training, as approved by the City, shall <br />be submitted along vith the license application /renewal and <br />maintained on file with the City. The Affidavit of Training <br />shall state that licensee's employees vho are involved in the <br />sale of tobacco products have received similar training from <br />licensee, have reviewed the City's tobacco products <br />regulations, and are aware of the consequences of violating the <br />regulations. <br />705.045 Sales to Minors. No person shall sell a tobacco product to <br />a person under 18 years of age. Any person convicted of violating this <br />section shall pay a fine of $50 for the first such conviction. Any <br />person convicted of violating this section twice within a 12 month <br />period shall pay a fine of $100. Any person convicted of violating this <br />section more than twice vithin a•24 month period shall be guilty of a <br />misdemeanor. <br />705.050 Administrative Fine, Suspension or Revocation. Any <br />violation of the City's Regulations relating to the issuance of a <br />Tobacco Products License or of any conditions /restrictions attached to <br />the issuance of such license shall be cause for the imposition of an <br />administrative fine, the suspension of the license or the revocation of <br />the license pursuant to the procedures described in Shoreview Code <br />Section 701.060. A licensee whose license has been revoked shall not be <br />eligible for another Tobacco Product License for one year from the date <br />of license revocation. <br />If the violation relates to the sale of tobacco products to minors <br />by licensee or licensee's employees, the following administrative fines, <br />suspensions or revocations shall be imposed: <br />A. The first such violation within 24 months shall subject the <br />licensee to the payment of an administrative fine of $200 if an <br />Affidavit of Training is on file for the employee who made the <br />illegal sale; or to the payment of an administrative fine of <br />$400 if no Affidavit of Training is on file for the employee who <br />made the illegal sale; <br />B. The second violation within 24 months shall subject licensee to <br />the payment of an administrative fine of $500 if an Affidavit of <br />Training is on file for the employee who made the illegal sale; <br />or to the payment of an administrative fine of $1,000 if no <br />Affidavit of Training is on file for the employee who made the <br />illegal sale; <br />700 -11 <br />Page 137 <br />
