JUN -18 -1996 14:42 CITY OF SHOREUIEW P.02/04 705 Tobacco Products 705.010 Definitions. Far purposes of this regulation, the following terms shall mean: (A) "Tobacco Product" means cigarettes; cigars; cheroots; stoggies; perique; granulated, plug -cut, crimp -cut, ready rubbed and other smoking tobacco; snuff; snuff flowers; cavendish; plug and twist tobacco; fine -cut and other chewing tobaccos; shorts; refuse scraps, clippings, cuttings and sweepings of tobacco and other kinds and forms of tobacco, prepared in such a manner as to be suitable for chewing or smoking in a pipe, or other tobacco related devices. (8) "Self- Service Merchandising" means a method of displaying tobacco products packaged in three or fewer individually wrapped containers which are accessible to the public without the intervention of an employee. (C) "Vending Machine" means any mechanical, electric or electronic device, appliance or any other medium or object designed or used for vending purposes which, upon insertion of money, tokens or any other form of payment, dispenses tobacco products. 705.020 License Required. No person shall, directly or indirectly, keep for retail sale, sell at retail, or otherwise dispose of Tobacco Products unless licensed by the City of Shoreview. License applications shall be submitted to the City Manager together with the license fee as determined from time to time by .City Council resolution. A license shall be issued for the specific premises identified in the application. 705.030 Term. A license shall expire on December 31st of each year. 705.040 License Restrictions. A license shall be issued subject to ' the following restrictions: (A) Vending machines used to dispense Tobacco Products shall not be located in an area which permits unrestricted access by a person under the age of eighteen (18) years even though such area may be under the supervision of the licensee or the licensee's agent or employee. This restriction shall apply to vending machines located in structures used for commercial, industrial, high -tech, office, tower or public purposes. (8) A licensee shall not offer for sale or otherwise dispense any Tobacco Product by Self- Service Merchandising. (C) A licensee shall comply with all applicable regulations of the State of Minnesota relating to the sale or dispensing of Tobacco Products. If there is a conflict between the regulations of the State and the regulations of the City, the more restrictive regulations shall control. . 700 -10 Page 136
