MINUTES <br />PLANNING COMMISSION <br />JUNE 13, 1996 <br />Montour stated that he did not support a lattice tower <br />if it could support panel antennas for only two <br />companies. Montour reported he has seen towers which <br />look like trees. <br />The City Planner indicated that a 150 foot high tree <br />would not blend in. <br />DeLonais stated that he would like more information on <br />this matter before he could support it. <br />Montour questioned the City's position if the company <br />would not negotiate in good faith with a competitor. <br />Montour asked if this occurred, if the City could <br />rescind the CUP. <br />The Planner replied that that was correct. <br />DeLonais stated that he would prefer additional <br />information about the technology involved and what the <br />future holds in this area. <br />The Administrative Assistant reported that technology <br />is changing so rapidly, it would be virtually <br />impossible to predict what the future holds. It was <br />also pointed out that cities are currently working on <br />the clearing up the issue of control of public rights - <br />of -way, and the FCC is in the rule- making process for <br />the Telecommunications Act of 1996. <br />Keis asked who would be responsible for removal of the <br />tower if it is abandoned. <br />Green replied that his contract with the property owner <br />requires that his firm remove the tower within a <br />certain time period if its use is abandoned. <br />Carson recommended approval of the Conditional Use <br />Permit to allow construction of a 151.5 foot free- <br />standing cellular telephone tower on the Donovan <br />property located at 53 S. Owasso Blvd. as requested by <br />Craig Green subject to compliance with recommendations <br />#2, #3, and #4 as contained in the City Planner's <br />report dated June 7, 1996. <br />Motion seconded by Keis. <br />In favor - Keis, Carson.
