The <br />lot is located on a cul -de -sac which results in an <br />irregular shape to the property. Rossbach pointed out <br />that there is no way to put an addition on the rear of <br />the house unless it is limited to a 7 foot width. <br />Therefore, Rossbach felt the shape of the property <br />created a hardship. Rossbach also suggested that given <br />these circumstances, Jebens cannot make the same use of <br />his property as is commonly enjoyed by his neighbors. <br />Rossbach felt a deck was every bit as permanent a <br />structure as a screened -in porch. Therefore, since the <br />porch is being constructed on the existing deck, <br />Rossbach felt the porch should be allowed. <br />The City Planner indicated that the Code allows the <br />encroachment of a deck into a required setback area as <br />long as it is no higher than the main floor of the <br />house. <br />Rossbach reported this differs from the other <br />communities he has worked in. Most communities require <br />decks meet setback requirements. Rossbach pointed out <br />that Mr. Jebens is not looking to go any closer to the <br />property line than he already is, and did nothing to <br />create the situation as it exists. Because of the odd <br />shape of the lot, the structure cannot go anywhere <br />else. Mr. Jebens wants to improve his property and <br />have the reasonable use of it. Jebens is proposing to <br />upgrade the quality of the structure and put a roof on <br />the existing deck. <br />Keis pointed out that the structure proposed is <br />actually a three - season porch with windows. <br />Rossbach agreed, but pointed out there will be no heat <br />to the porch. Jebens wants to improve the deck so it <br />can be used in inclement weather. <br />Keis asked if there would be windows, carpeting, and <br />furniture in the porch. <br />Rossbach replied that there would. Windows will be <br />single - glaze, and he encouraged Jebens to install <br />windows to keep snow from drifting into the porch. <br />Carpeting will be installed since it is less expensive <br />than putting in a cedar floor. <br />Jebens pointed out that the house is pushed back on the <br />2 <br />Page 23 <br />
