SURVEY ON DECKS CONVERTED TO PORCHES <br />Arden Hills - <br />Arden Hills requires decks to meet the same setback requirements <br />as livable space. Those setbacks are an aggregate of 25 feet for <br />side yard setback (minimum 10 feet on one side yard, and 15 feet <br />on the other), and 30 feet for the rear yard setback. Any <br />encroachment into the setback would require a variance. <br />Falcon Heights - <br />Decks are allowed to be constructed 5 feet from the side and rear <br />property lines. Decks are defined as "uncovered ". Setbacks for <br />living space are 5 feet from the side property line and 30 feet <br />from the rear. A 3- season porch would be considered as living <br />space, therefore, would have to meet the 30 -foot rear yard <br />setback. However, Falcon Heights have approved some variances <br />for porches encroaching into the required rear yard in situations <br />where the lot was small and there was little rear yard area. <br />Maplewood - <br />Maplewood has different setbacks for open decks versus living <br />space. A deck has a 5 -foot side yard setback, living space 10 <br />feet. A deck has a 5 -foot rear yard setback, living space is 20% <br />of the lot depth. In order to convert a deck which encroaches <br />into the setback for living space into a porch, a Conditional Use <br />Permit would be required. Maplewood chose to use the CUP process <br />versus Variance since approval of a CUP is easier and more <br />subjective than a Variance. <br />Roseville - <br />At -grade decks are allowed to encroach into the required side and <br />rear yard setback. Any structure with a roof or living space <br />would not be considered a deck. Therefore, a 3- season porch <br />would be considered living space and not allowed to encroach into <br />the required rear yard. Roseville's rear yard setback is 30 <br />feet. <br />Shoreview - <br />Shoreview has different setbacks for decks, garages, and <br />accessory structures than for living space. The Planner I spoke <br />with said there is a problem with their code in that a 3- season <br />porch would be considered a deck, and therefore would be allowed <br />to have the same setbacks as a deck. However, staff is working <br />on a Code amendment which would define a deck as an open deck or <br />Page 30 <br />
