MINUTES CITY COUNCIL APRIL 12, 2006 property owner relative to a street improvement. This situation will be more challenging given there are 62 property owners involved. Jim Kolasch, 131 Canabury CourC, reported that the townhouse project was constructed 35 years ago and the association has never been able to assess adequate dues to set aside funds for improvement of the access roads and parking areas. These areas are now unrepairable, and the association needs assistance from the City in constructing and financing the cost of the improvement. It would be very difficult for the association to collect the cost of these improvements from property owners at one time. Kolasch stated that the association would appreciate the City's working with them on this matter. Blesener asked the possibility of the townhouse association obtaining waivers from all 62 property owners. Kolasch indicated thaC there are some new homeowners in their complex that may not understand the situation at this time, but felt it could be communicated. Kolasch stated that he did not foresee any difficulty at this time. He also reported that the association will be holding its annual meeting on Wednesday, April 19°i, at 6:30 p.m. aC Che Old Fire Hall. The matter will be discussed with the ownership at Chat time, and Kolasch invited the City Administrator Yo attend. LaValle stated that this appears to be a worChwhile projecC and he would support it if the details can be worked out. LaValle asked what would happen if one or two property owners refused to sign the waiver. Kolasch indicated that the townhouse association has utilized assessments for many projects over the years, noting that the complex was reroofed in 2004. Each of the property owners have paid their assessments for the various projects. Kolasch stated that the willingness is there on the part of the townhouse owners, it is only the details that need to be worked out. LaValle suggested that Che City obtain a copy of the association's by-laws to determine if there is anything in thaC document that would impact this issue. Blesener asked if the townhouse association can assess for an improvement if they do not have the agreement of each and every property owner. The City Attorney reported that he has not looked into all the details of this matter, but agreed iC was similar to the Ryan Drive improvement noted by the City Administrator.
