MINUTES <br />CITY COUNCIL <br />APRIL 12, 2006 <br />property owner relative to a street improvement. This situation will be <br />more challenging given there are 62 property owners involved. <br />Jim Kolasch, 131 Canabury CourC, reported that the townhouse project <br />was constructed 35 years ago and the association has never been able to <br />assess adequate dues to set aside funds for improvement of the access <br />roads and parking areas. These areas are now unrepairable, and the <br />association needs assistance from the City in constructing and financing <br />the cost of the improvement. It would be very difficult for the association <br />to collect the cost of these improvements from property owners at one <br />time. Kolasch stated that the association would appreciate the City's <br />working with them on this matter. <br />Blesener asked the possibility of the townhouse association obtaining <br />waivers from all 62 property owners. Kolasch indicated thaC there are <br />some new homeowners in their complex that may not understand the <br />situation at this time, but felt it could be communicated. Kolasch stated <br />that he did not foresee any difficulty at this time. He also reported that the <br />association will be holding its annual meeting on Wednesday, April 19°i, <br />at 6:30 p.m. aC Che Old Fire Hall. The matter will be discussed with the <br />ownership at Chat time, and Kolasch invited the City Administrator Yo <br />attend. <br />LaValle stated that this appears to be a worChwhile projecC and he would <br />support it if the details can be worked out. LaValle asked what would <br />happen if one or two property owners refused to sign the waiver. <br />Kolasch indicated that the townhouse association has utilized assessments <br />for many projects over the years, noting that the complex was reroofed in <br />2004. Each of the property owners have paid their assessments for the <br />various projects. Kolasch stated that the willingness is there on the part of <br />the townhouse owners, it is only the details that need to be worked out. <br />LaValle suggested that Che City obtain a copy of the association's by-laws <br />to determine if there is anything in thaC document that would impact this <br />issue. <br />Blesener asked if the townhouse association can assess for an <br />improvement if they do not have the agreement of each and every property <br />owner. <br />The City Attorney reported that he has not looked into all the details of <br />this matter, but agreed iC was similar to the Ryan Drive improvement <br />noted by the City Administrator. The Attorney indicated that the Ryan <br />Drive property owners were represented by one attorney who did all the <br />4 <br />
