It was an <br />extremely complicated project as is this one. <br />Blesener suggested that City staff be authorized to look further into the <br />matter at this time to determine if Chere is a way to assist the townhouse <br />association. The results of that research will Chen be brought back to the <br />Council for action. <br />Mr. LaValle introduced Che following resolution and moved its adoption: <br />RESOLUTION NO. 2006-4-87 -AUTHORIZING THE CITY <br />ADMINISTRATOR AND CITY ATTORNEY TO RESEARCH THE <br />CITY'S ABILITY TO ASSIST THE CANABURY TOWNHOUSE <br />ASSOCIATION WITH THE IMPROVEMENT AND FINANCING <br />THEREOF OF PRIVATE ACCESS ROAD AND PARKING LOTS <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City AdminisCraCOr indicated that if a plan/policy is ultimately adopted <br />by the Council, it will serve as a guideline for future similar situafions. <br />THE The City Administrator reported that the attorney representing Dayspring <br />PRESERVE Development has reviewed the proposed development agreement for The <br />DEVELOPMENT Preserve and has suggested some changes to that agreement. The <br />AGREEMENT Administrator reviewed the substantive changes. These include the <br />renumbering of the exhibits which the Administrator felt was an <br />acceptable change. He noted that Dayspring's attorney wanted #5 <br />changed to eliminate the "no recourse" against the City. The <br />Administrator reported that the City Attorney has recommended against <br />Chis change. Dayspring's attorney also requested a change to #6 to include <br />a 30 days notice provision which the City Attorney recommended against. <br />The City Administrator further reported that the Dayspring attorney <br />wanted #8 in the agreement included in the agenda packet deleted given <br />that the plat has already been recorded. This change was acceptable to the <br />City Administrator and City Attorney. The Administrator reviewed <br />proposed changes to #10 relative to letter of credit reductions, pointing out <br />Chat there is one additional reduction over the City's normal course of <br />action at the point that the Magellan pipeline lowering is completed. <br />With regard to the underlined language in #25, Dayspring's attorney <br />recommends a contingent approval subject to the City Engineer's review <br />of the Magellan pipeline.
