MINUTES <br />Planning Commission <br />Jan. 10, 1085 <br />Jim Eddy <br />(Cont.) <br />Mr. Costa replied that the City usually deals with these things on a <br />complaint: basis. <br />Mr. Crittman asked Mr. Eddy if he has filled out an application for <br />a home occupation permit. Mr. Eddy replied that he has not. <br />Mrs. Kingsbury informed the audience that not all the neighbors are <br />in favor of the business as the City has received a complaint. <br />Kingsbury also noted that the person complaining probably does not <br />know the matter is being discussed as it is not on the agenda. <br />Mrs. Timmons stated that Mr. Eddy has to fill out an application for <br />a permit and suggested that the matter he referred to the Council <br />without any action. <br />Mr. DeLonai.s felt that Mr. Eddy's business should be required to <br />comply with all provisions of the home occupation ordinance. <br />Mr. Grittman stated that under the ordinance one tow truck would <br />he acceptable, but two would be in violation of the ordinance. <br />Mr. Costa asked how many wrecked cars are on the premises at one time. <br />Mr. Eddy replied that the scrap yards are not open on the weekends. <br />Mrs. Timmons asked if the Building Inspector gave Mr. Eddy a copy <br />of the procedure to follow for a home occupation permit. Mr. Eddy <br />replied that he did. <br />Mrs. Timmons did not feel that the Commission could decide this <br />matter until it had all the facts before it. Timmons pointed out <br />that there may be other neighbors in the area not happy with <br />this situation. <br />Miss Frantzen asked why Mr. Eddy should lose his business because one <br />person complained about it. Mrs. Timmons pointed out that the area <br />is a residential one and the person who complained has the right to <br />keep the area residential. Mrs. Timmons stated that the Commission <br />is probably not hearing both sides of the issue tonight. <br />Mr. Herkenhoff stated that he felt if the City singled Mr. Eddy out, <br />it would be causing a lot of problems with the other home occupations <br />in the City. <br />Mrs. Timmons pointed out that there are other home occupations in the <br />City that the City has denied and people have had to relocate their <br />businesses. <br />Mr. DeLonais stated that this business has gone beyond the limits <br />or a little business. DeLonais stated that three or four trucks is <br />not a little business. <br />Page —4— <br />1 <br />
