MINUTES
Planning Commission
( Jan. 10, 1935
Jim Eddy
(Cont.)
Mrs. Timmons felt that the Commission needed more information before
it could act.
Mr. Herkenhoff recommended that home occupi_ionpermi.t for Mr. Jim
Eddy be approved in light of the fact that the neighbors have
indicated that the business is not a problem and that the business
meets the provisions of the ordinance covering home occupations.
Motion seconded by Mr. Perlinger.
Ayes (3) Perlinger, Herkenhoff., French.
Nayes (5) DeLonais, Costa, Kingsbury, Timmons, Davison.
Motion denied.
Mr. Costa recommended that Mr. Eddy scale down his operation before
bringing the matter to the Council. Costa felt that the permit might
get approved if there were only one tow truck involved. Costa
informed Mr. Eddy that his operation is too big for the property
and at times the area has looked pretty rough.
Miss Frantzen asked why Mr. Eddy should pay property taxes if he
cannot operate his business. Mr. Costa pointed out that Mr. Eddy
is paying residential property taxes and that people in the area
have a right to protect their homes.
Mr. Frantzen asked if the City would approve the permit if Mr. Eddy
parked some of his trucks at his home.
Mrs. Timmons stated that she did not feel that the City would allow
Mr. Eddy to spread his business throughout the neighborhood.
Mr. Herkenhoff asked how many cars a homeowner could have on a property.
Mr. Grittman replied that as long as the vehicles are licensed,
and parked in the garage or driveway, a homeowner could have as many
as they wanted.
Mr. Frantzen pointed out that the City rented property in the neighbor-
hood in the past for City vehicles. Mr. Costa stated that the City
now has a new ordinance since that time.
Mr. Costa stated that four trucks and wrecked vehicles sometimes
turned upside down are very unsitely. Costa stated that the operation
is too big for a residential area.
Mrs. Timmons suggested that Mr. Eddy meet with the Planner and he
could tell him what the ordinance requires. Timmons felt that the
Commission should have a Planner's report on this matter and a public
hearing should be held. Then, everyone in the neighborhood will be
notified. Timmons informed the audience that even if the neighborhood
is in favor, the Council could still deny the permit.
Page -5-
