David Licht <br />DATE: 11 March 1985 <br />RE: O'Keeffe Subdivision <br />FILE NO: 758.09 - 85.06 <br />CASE BACKGROUND <br />An application for the subdivision of three parcels of land has been filed <br />by Rockne Waite, Coldwell Bankers on behalf of Marie O'Keeffe. The property <br />in question is located west and north of and includes 147 Old County Road <br />C East (see attached location map). <br />Technically, this division of land requires a formal plat. Based upon past <br />precedent, it is assumed, however, that the division will be allowed to <br />proceed under a registered land survey. <br />CASE ANALYSIS <br />The area in which the property to be divided is located is a developed, <br />established single family neighborhood, zoned R -1. The lots which are <br />proposed (see Attachment B) are within the requirements of this district, <br />each having in excess of 10,000 square feet. <br />A site inspection of the property indicates that a drainage swale exists to <br />the rear of the lots fronting on Old County Road C and Blumwood Avenue. <br />This drainage area appears to empty into a ditch about two to three houses <br />west of the O'Keeffe property. It would appear essential that this drainage <br />swale be maintained as part of the development of the O'Keeffe's property. <br />Lacking a formal plat, possibly the best way to insure this would be through <br />a simple development agreement which is filed against the title of the <br />properties. Likewise, a development agreement also appears to be a vehicle <br />whereby six foot drainage and utility easements can be imposed upon the <br />property without significant legal review costs being incurred. <br />4820 minnetonka blvc. minneapolis, minnesota, ste. 420 55416 tel. 612/925 -942E <br />
