Little Canada Mayor and City Council
Little Canada Planning Commission
11 March 1985
Page Two
RECOMMENDATION
Although we again must state our questioning of the City's registered land
survey division procedure, our finding is that the proposed O'Keeffe
subdivision conforms to City policies and Zoning Ordinance requirements.
In view of this fact, we recommend approval subject to a development agree-
ment being established and filed against the titles of the newly created
parcels. This agreement should require the following:
1. Six foot drainage and utility easements being placed along all lot
lines.
2. At the time any building permits are submitted for approval, the
respective owners provide the City Engineer with an acceptable grading
and drainage plan (which includes garage floor elevations) protecting
the rear yard drainage swale and handles site drainage in an approved
fashion.
ADDITIONAL COMMENT
Note should be made that the existing O'Keeffe house and rear yard accessory
building are in violation of R -1 district setback standards. As such, the
existing house and accessory building establish a non - conforming status and
restrictions to this property.
As these site problems are along the east property line, they do not
influence the subdivision question, nor can they be corrected through the
requested division.
cc: Park Commission
Joseph Chlebeck
Don Carley
Lowell Nagovski
Tom Sweeney
Rockne Waite
Marie O'Keeffe
17
