Wabasha Street <br />St. Paul, Minnesota 55102 <br />RE: Little Canada - O'Keeffee Subdivision <br />File No: 758.09 - 85.06 <br />Your File No: 5504 <br />Dear Tom: <br />Being informed of your absence from the office for this next week, I <br />felt it advisable to respond in writing to your letter of 28 March <br />on the above referenced request. <br />Your correspondence questioned the meaning of our report relative to <br />utilizing a development agreement to assure the acquiring of drainage <br />and utility easements. This recommendation goes back to our very strong <br />feeling and concern that the City protect itself, especially on un- <br />platted property, by reserving six foot drainage and utility easements <br />along all property lines. As you are aware, there has been very strong <br />reluctance to require such easements in view of legal costs involved in <br />title opinions. <br />The thought behind our recommendation to have easements assurred through <br />a developers agreement is an attempt to avoid the title search and <br />opinion issue. By having the developers agreement assure the easements, <br />this recorded document would assumably give the City later recourse <br />should the property owner fail to provide easements which are a <br />stipulation of subdivision approval.
