L <br />This contract is made and entered into this _ day of <br />1985, between the City of Little Canada and Tomas Horvath. <br />.11LF:EAS, the City of Little Canada hereinafter City, is desirous of <br />contracting for tree inspection services in order to operate its diseased <br />tree removal program, and <br />'.HEREAS, Thomas Horwath hereinafter I:orwath, is a licensed tree inspector <br />licensed by the Etate of Minnesota and is interested in providing these <br />services on a independent contract hasis to the City. <br />NOW, TI.Ei{P:I'URE, IP< CONSIDERATION OF THE 1'- ;'yr1JAL CUVENAN2S C I.'PAILED <br />=IN, IT IS AGREED BET,;IEle THE PARTIM THAT: <br />1. Horwath agrees to maintain his state tree inspection certification <br />for the duration of this contract. <br />2. Horvath agrees to provide tree inspection services based on the <br />1983 tree inspection schedule. <br />3. Horvath agrees to provide tree inspection services as outlined <br />in this contract in the manner as designated,by the appropriate represen- <br />tative:- of the City. <br />4. In consideration of ISorwath's services the City will pay Horwath <br />at the rate of ii9.50 per. hour. <br />5. It is hereby expressly understood by the City and Horwath expressly <br />represents that he is an independant contractor for the purpose of providing <br />tree inspection services to the City and shall not he entitled to any of the <br />usually accrued benefits of regular City employees including, but not lim- <br />ited to, severance pay, health and welfare insurance benefits, retirement, <br />withholding of State and Federal taxes PICA, social security withholding, <br />C <br />
