MINUTES City Council July 25, 1984 Lynch Lot Split (Cont.) Manes Lot Split Agenda Item No. 6 required around the lot lines. Mr. Fahey informed Mrs. Lynch that this is required under City Code. The City Attorney stated that either he can draw up the easements, or Mrs. Lynch's attorney can do it. The Attorney stated that he would still have to confirm title on the property. The Attorney informed Mrs. Lynch that he will need the certified abstract of the property to review. Mrs. Nardini commented that a portion of the property is low. Nardini asked if Shoreland requirements would come into play on this property. Mr. Forsberg stated that if there is a low area on the property, a home could be built in another portion of the property that is high. Mr. Grittman stated that this is a building permit situation. Mrs. Nardini stated that item 1 in the Planner's report should be revised to read drainage easement rather than utility. Mrs. Nardini introduced the following resolution and moved its adoption: RESOLUTION NO. 84 -7 -322 — APPROVING THE LYNCH LOT SPLIT SUBJECT TO THE PLANNER'S REPORT OF JUNE 19, 1984 AND SUBJECT TO THE PROVIDING OF DRAINAGE EASEMENTS ALONG THE LOT LINES AND THE UPDATING OF THE ABSTRACT FOR THE PROPERTY The foregoing resolution was duly seconded by Mr. Forsberg. Ayes (4) Nardini, Forsberg, Scalze, Fahey. Nayes (0). Resolution declared adopted. This resolution appears in Resolution Book No. 11, Page 340. The Clerk reported that the City has already received the utility easements for the Manes Lot Split. Mr. Forsberg reported that Mr. Manes wants to sell off 122 feet of his property to his neighbor to the east who wants it for open space. Mr. Fahey pointed out that the reason for the proposal for the future development of the property was that the ordinance requires this on large parcels of property. Mr. Fahey stated that the Council could require the adjoining land owner to combine the property with his.
