Little Canada Planning Commission <br />11 June 1985 <br />Page Two <br />Proposed features: <br />• A curb cut allowing egress onto Minnesota Avenue occuring sixty <br />feet east of the intersection of Minnesota Avenue and Rice Street. <br />• This curb cut is located approximately 120 feet from existing <br />Minnesota Avenue access. <br />• McDonald's Corporation owns 382.64 feet of frontage on Minnesota <br />Avenue. <br />• Two additional parking spaces are proposed as well as two waiting <br />spaces for special grill orders located out of the flow of drive - <br />through traffic. <br />RECOMMENDATION <br />The proposed curb cut and egress satisfy the requirements of the Zoning <br />Ordinance and therefore qualify for approval. In addition the proposal <br />more efficiently addresses some of the concerns raised at the time of the <br />drive - through facility approval. There should no longer be a problem with <br />patrons exiting onto Rice Street. The new egress and existing parking lot <br />striping direct all traffic out onto the less congested Minnesota Avenue. <br />SIGN VARIANCE ANALYSIS <br />The McDonald's property is located in an area zoned B -3, General Business <br />District. Section 903.110 specifies: <br />• One sign per premise is allowed. <br />• Signs cannot be located less than five feet from the property line. <br />• Signs may not take up any required parking space. <br />o The maximum allowable freestanding sign., size determined by gross <br />area of restaurant, cannot exceed sixteen feet in height or a total <br />area of 104 square feet, <br />In addition, Section 922.010 states that a variance shall not be granted unless <br />it can be demonstrated that: <br />e Special conditions (not economic) and circumstances exist which are <br />peculiar to the land, structure or building involved. <br />• Literal interpretation of the provisions of this ordinance would <br />deprive the applicant of right commonly enjoyed by other properties <br />in the same district under the terms of this ordinance. <br />• The special conditions and circumstances do not result from the actions <br />of the applicant. <br />• Granting the variance requested will not confer on the applicant any <br />special privilege that is denied by this ordinance to other lands, <br />structures, or buildings in the same district. <br />o A genuine hardship exists in complying with the literal terms of <br />this ordinance. <br />8 <br />
