MINUTIJS <br />CITY COUNCII, <br />APRIL 26, 2006 <br />KCM HOLDINGS UNTIL THE MAY 24, 2006 REGULAR COUNCIL <br />MEETING <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />TEXT Blesener opened the Public Hearing to consider a Text Amendment to <br />AMI;NDMI;NT- the Shoreland District decreasing the required front yard setback in the <br />SHORELAND Single-Family Zoning District to thirty (30) feet. It was noted that the <br />012DINANCI; City Planner and the Planning Commission have recommended approval <br />of the text amendment. <br />The City Planner noted that the purpose of the change is to make the font <br />yard setback for single-family properties consistent between the Shoreland <br />District and the Single-Family District. Currently the Shoreland District <br />requires a fifty (50) foot front yard setback for single-family homes while <br />the Single-Family District requires thirty (30) feet. The Planner noted thaC <br />this would be consistent with the way the City has applied this Code. <br />Allan reported that she had asked the DNR to comment on this change. <br />While the DNR did not think it was a problem making this change, but <br />they asked for comments from MN DOT. Allan reported that MN DOT <br />has not responded to the proposal; therefore, suggested thaC the Council <br />proceed to act on the Amendment. <br />Mark Pechman, 2566 Edgerton Street, noted that this issue first came up in <br />relation to the sports court on Edgerton Street. Pechman suggested that <br />given the Text AmendmenC to allow the sports courC was not approved, <br />there was no need to proceed with decreasing the front yard setback <br />requiremenC in the Shoreland District to thirty feet. <br />The City Administrator noted Chat there are many properties along <br />Edgerton Street thaC have a thirty foot front yard setback rather than fifty. <br />He noted that action on the Text Amendment was only tabled pending <br />comments from the DNR. The proposed Text Amendment makes the <br />front yard setback consistent with that of the R-1 District and will lessen <br />the non-conformities along Edgerton Street. The Administrator stated that <br />the Text Amendment is not related Co the sports court issue. He further <br />noted that the Council did not allow the sports court and it must be <br />removed by June ]s` <br />Pechman asked if the Text Amendment would then allow a garage to be <br />constructed with a 30 foot setback from Edgerton Street.
