MINUTES <br />CITY COUNCIL <br />APRIL 26, 2006 <br />Administrator replied that the garage would have to meet all the City's <br />Code provisions. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Montour, seconded by Keis, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2006-4-IOI -ADOPTING THE TEXT <br />AMENDMENT AMENDING SECTION 917.030 OF THE CITY CODE <br />RELATING TO MINIMUM LOT AND SETBACK REQUIREMENTS <br />WHICH DECREASES THE FRONT YARD SETBACK IN THE <br />SINGLE-FAMILY (R-I) DISTRICT TO THIRTY (30) FEET <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />30% The City Administrator noted that Mike and Heidi Murphy, 601 <br />IMPi/RVIOUS County Road B-2 East, applied for a Text Amendment that would <br />SURFAC)J allow horseshoe driveways by Conditional Use Permit and were <br />ISSUE subsequently granted a CUP for a horseshoe driveway subject Co <br /> compliance with ordinance conditions. In evaluating the Murphy's <br /> horseshoe driveway plan, City staff measured the amount of impervious <br /> surface area on the property and found it to be at 44%. The amended <br /> Code states that overall impervious surface cannot exceed 30%. The City <br /> Administrator noted that a stricC interpretation of the Code would not <br /> allow the Murphy's to have a horseshoe driveway. The Administrator <br /> asked the Council's intention in this regard. He noted that if the intention <br /> was to allow Che horseshoe drive even Chough the impervious surface area <br /> is over the 30%, another text amendment will need to be enacted. The <br /> Administrator also pointed out that Che Shoreland District has an <br /> impervious surface limitation of 30%. <br />Blesener reported that after reviewing this ordinance and looking at his <br />own property, just his house and driveway would consCitute about 40% <br />impervious surface. Blesener stated that he would be willing to amend the <br />ordinance to allow a horseshoe driveway on a property that has more than <br />30% impervious surface provided that the driveway area being added is <br />pervious. Blesener suggested that the City could also add requirements for <br />mitigation such as the addition of rain water gardens. <br />
