5 The sending municipality shall be responsible for its own personnel, equipment, and supplies, and the receiving muni- cipality shall not be held liable for any injuries to personnel or damage to equipment of the sending municipality, nor shall the receiving municipality be required to reimburse the sending municipality for supplies used or the cost of personnel and equipment while so engaged, except that any monies received by the receiving municipality from other non - participating agen- cies to reimburse the cost of such personnel, equipment, and supplies shall be remitted to the sending municipality in an amount equivalent to the percentage of total cost reflected by the monies received, along with any equipment and supplies unused upon the termination of the emergency. Supplies furnished or drawn from pool sources shall be replaced or reimbursed for by the receiving•municipality. 6. The sending municipality shall not be responsible for any injuries, losses, or damage to persons or property arising out of the act of any of the personnel of the sending or receiving municipalities. 7. In case weather, road conditions, or other circumstances are such that, in the discretion of the Civil Defense /Emergency Services Director of the sending municipality, or his designee, equipment, personnel, and supplies cannot be furnished to the receiving municipality with reasonable safety he may, in his discretion, refuse to authorize and direct assistance to the receiving municipality. The determination of the Civil Defense /Emergency Services Director of the sending munici- pality, or his designee, as to what assistance as provided herein shall be sent to the receiving municipality, shall be final and conclusive, and shall give rise to no liability on the part of the sending municipality for failure to furnish such assistance. This agreement shall be effective only during periods when a Civil Defense emergency is in effect and duly declared pursuant to local ordi- nance, state or federal law. This agreement may be executed in several counterparts and also executed shall constitute one (1) agreement, binding on all of the parties hereto notwithstanding that all of the parties are not signatory to the original of .the same counterpart. This agreement shall be effective after its approval and execution by the parties endorsing this agreement and shall continue in effect thereafter until and unless it is amended by the parties to this agreement or cancelled by any party upon written notice to all other parties.
