PLANNING REPORT <br />northwest associated consultants, inc. <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 11 February 1986 <br />RE: I Judd Property Division <br />FILE N0: 758.09 - 86.02 <br />BACKGROUND <br />Mr. Tom Judd has applied for a lot split and a variance for a side yard <br />setback for a building on the southernmost lot. The parcel lies between the <br />Soo Line Railroad and the unimproved Jackson Street. An existing house sits <br />on the northern lot and has its driveway access to Bluwood Avenue. <br />ANALYSIS <br />Subdivision <br />The subdivision request would be routine except for the existence of the <br />Jackson Street right -of -way. The new lots would be 22,860 square feet for <br />the north lot and 11,364 square feet for the south, both in excess of the <br />minimum. However, were Jackson Street to be dedicated and improved, the new <br />south lot would not conform, particularly when the needed street dedication <br />was taken. In light of past City action, including the approved location of <br />the north house, Jackson Street will never be put through. It would be our <br />recommendation that this portion of Jackson be vacated and returned to adjoin- <br />ing property owners. The water line in the right -of -way could be covered by <br />an appropriate utility easement. <br />Setback Variance <br />The new house will gain road access to the south, regardless of the Jackson <br />Street status. If the street remains, the side yard setback adjoining a <br />public street is 30 feet. The width of the lot at the setback line is <br />approximately 79.5 feet. A setback variance would technically not be justified <br />as no physical hardship exists.
