Little Canada Planning Commission,
Mayor and City Council
4 January 1982
Page Two
It should be noted that both of the proposed lots will be somewhat deeper
than a standard 10,000 square foot lot. As a result, both lots still
conform to the minimum lot area requirement. In fact, the northernmost
lot contains 11, 160 square feet.
RECOMMENDATION
Section 922 of the Zoning Ordinance provides conditions and criteria for
considering variances. It is the opinion of this office that a variance
is justified for the following reasons: 1) the variance is required
due to the wedged shape of the property, 2) the extra depth of the property
still allows the property to meet or exceed the minimum 10,000 square foot
area requirement, and 3) the lots are wider at the property line (approxi-
mately 79+ feet) than a standard rectangular lot. Finally, the shape of
the property is not so irregular as to require any further variances in
terms of the building setbacks. As shown on Exhibit E, a fairly sub-
stantial buildable area remains even after the setbacks are considered.
Subject to review and comment by the City Engineer and City Attorney, it
is reconnended that the request be approved as presented.
cc: (ioe Chlebec
Thomas weeney
Don Carley
Ed Locke
Dennis Peck
8
